My Loved One Passed Away and I Need to Transfer Their Car Title. What Do I Do?

Car title in Texas can be transferred via a motor vehicle Affidavit of Heirship. This is a form put out by the Texas Department of Motor Vehicles. It must be signed by all the heirs of the person who passed away. You must also check on the form whether the Decedent left a will. The form must be signed in front of a notary.

The heirs are as follows:

  • If the Decedent has left a surviving spouse and no children, the surviving spouse is the heir.
  • If the Decedent has left a surviving spouse and children who are also the children of the surviving spouse, the surviving spouse is the heir.
  • If the Decedent has left a surviving spouse and children who are not the children of the surviving spouse, the surviving spouse and children are the heirs.
  • If the Decedent left no surviving spouse, the heirs are the children.
  • If the Decedent left no surviving spouse and no children, consult with an attorney regarding who are the heirs.
